These Terms and Conditions govern purchases from and use of services provided by Peach Magnolia Studio ("Peach Magnolia Studio," "we," "us," or "our"). By placing an order, approving a design proof, providing an item for engraving, or using our website at [website URL], you agree to these Terms and Conditions.

Products and Services

Peach Magnolia Studio provides laser engraving, personalization, design, and related services. Product descriptions, photographs, samples, and digital mockups are provided for general reference. The finished product may differ slightly because of material characteristics, screen settings, equipment, and the engraving process.

We reserve the right to refuse or cancel an order that:

Contains unlawful, hateful, threatening, defamatory, or otherwise inappropriate content.
Infringes or appears to infringe another person's intellectual-property rights.
Cannot be produced safely or to an acceptable standard.
Contains an obvious pricing, availability, or description error.
Violates these Terms and Conditions.

If we cancel a paid order before production, we will refund the amount paid for the canceled portion, except for completed design work or other nonrefundable services disclosed in advance.

Orders and Personalization

Customers are responsible for providing complete and accurate order information, including:

Names, dates, spelling, punctuation, and wording.
Dimensions, quantities, colors, materials, and product selections.
Artwork, logos, photographs, and engraving instructions.
Billing, shipping, and contact information.

Order changes are not guaranteed after payment, proof approval, or the start of production. Changes may result in additional charges and extended processing time.

Design Proofs and Approval

We may provide a digital proof before production. The customer must review the entire proof carefully, including spelling, layout, dates, dimensions, and placement.

Approval authorizes Peach Magnolia Studio to produce the order as shown. We are not responsible for customer-submitted errors that appear in an approved proof. If the finished product materially differs from the approved proof because of our error, we will provide an appropriate remedy under our Return and Refund Policy.

Digital proofs are visual representations and may not perfectly reproduce the finished product's color, texture, engraving depth, or scale.

Prices and Payment

Prices are listed in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, design fees, rush fees, and other costs will be disclosed at checkout or in the customer's quote.

Full payment is due when the order is placed/before production begins, unless otherwise agreed in writing. Deposits for custom, bulk, or business orders may be nonrefundable once design work, material purchasing, or production has begun.

We may correct pricing or description errors. If an error affects an existing order, we will notify the customer and allow the customer to accept the corrected terms or cancel the affected portion for a refund.

Turnaround and Completion Dates

Processing and production times are estimates and begin only after we have received payment, required information, materials, and proof approval.

Completion and delivery may be affected by:

Delayed customer responses or proof approvals.
Product or material availability.
Order complexity or quantity.
Equipment failure, carrier delays, weather, emergencies, or other circumstances outside our reasonable control.

A requested event date does not guarantee delivery by that date unless we expressly confirm the deadline in writing.

Custom and Personalized Sales

Because custom and personalized products are made specifically for the customer, all custom and personalized sales are final, except when an item is damaged, defective, or materially different from the approved order because of our error.

Cancellations, returns, exchanges, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms and Conditions.

Natural Material Variations

Wood, leather, slate, stone, glass, coated metals, and other materials may vary in color, grain, texture, thickness, markings, or engraving response. Natural variations, minor placement differences, and ordinary variations in engraving depth or appearance are not defects.

Customer-Supplied Items

We may agree to engrave an item supplied by the customer. Laser engraving may expose preexisting weaknesses or cause unexpected results, including cracking, warping, discoloration, coating failure, uneven marks, or damage caused by an item's composition.

Before accepting a customer-supplied item, we may:

Inspect or test the item.
Decline materials that cannot be safely identified or engraved.
Require a spare item for testing.
Request proof of the item's material composition or value.
Require written acknowledgment of the risks.

Unless prohibited by law or caused by our negligence, the customer accepts the ordinary risks associated with engraving customer-supplied items. If our negligence directly damages such an item, our maximum responsibility will be limited to the documented replacement value/a maximum of the part number on the manufacturer website/customer service portal. Proof of purchase or value may be required.

Customer Content and Intellectual Property

The customer retains ownership of original content submitted for an order. By submitting names, photographs, artwork, logos, text, or other content, the customer grants Peach Magnolia Studio a limited license to copy, modify, format, and use that content as necessary to prepare proofs, produce the order, communicate with the customer, and maintain reasonable business records.

The customer represents that they own the submitted content or have permission to use and reproduce it. The customer is responsible for claims arising from content submitted without authorization.

We may decline requests involving protected characters, trademarks, logos, copyrighted artwork, or other intellectual property when adequate permission has not been demonstrated.

Studio Designs and Content

Unless otherwise agreed in writing, Peach Magnolia Studio retains ownership of its original designs, templates, product photographs, mockups, website content, graphics, processes, and branding. Purchasing a finished product does not transfer ownership of the underlying design or grant permission to reproduce, resell, distribute, or commercially use it.

Exclusive design ownership, source files, or commercial-use rights must be purchased or granted under a separate written agreement.

Portfolio and Promotional Use

We will not publicly display an identifiable custom order, personal photograph, private message, or customer logo for promotional purposes without permission.

With the customer's consent, we may photograph and display completed work on our website, social media, portfolio, or marketing materials. Consent may be withdrawn for future use by contacting us, but withdrawal may not require removal of printed materials already produced or content previously shared by third parties.

Shipping, Delivery, and Pickup

Shipping, tracking, delivery, local pickup, damaged packages, and lost shipments are governed by our Shipping Policy, which is incorporated into these Terms and Conditions.

Customers are responsible for providing accurate shipping information and collecting pickup orders within the stated period. Risk of loss passes to the customer upon confirmed delivery, except where applicable law provides otherwise.

Website Use

You may use our website only for lawful purposes. You may not:

Attempt to interfere with the website's operation or security.
Introduce malware or harmful code.
Collect information through unauthorized automated means.
Misrepresent your identity or payment authority.
Copy, reproduce, or commercially exploit website content without permission.
Use the website to violate another person's rights or applicable law.

We may suspend or restrict access for conduct that violates these Terms and Conditions.

Third-Party Services

We may rely on third parties for payments, website hosting, communications, shipping, analytics, or other services. Their terms and privacy policies govern their services. We are not responsible for third-party outages, delays, or conduct beyond our reasonable control.

Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms and Conditions.

Disclaimer of Warranties

To the extent permitted by law, products and services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, except where such warranties cannot legally be excluded.

Nothing in these Terms limits any warranty or consumer right that cannot be waived under applicable law.

Limitation of Liability

To the fullest extent permitted by law, Peach Magnolia Studio will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, lost data, or missed events.

Our total liability arising from an order will not exceed the amount the customer paid for the product or service giving rise to the claim, except where applicable law prohibits that limitation.

Indemnification

To the extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Peach Magnolia Studio and its owners, employees, and contractors from claims, losses, liabilities, and reasonable expenses arising from:

Content or materials submitted by the customer.
The customer's infringement of another person's rights.
The customer's unlawful use of a product or service.
The customer's material violation of these Terms and Conditions.

Events Beyond Our Control

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, illness, labor disruptions, power or internet outages, equipment failure, material shortages, government actions, carrier interruptions, or other emergencies.

We will make reasonable efforts to communicate delays and complete affected orders when practical.

Governing Law and Disputes

These Terms and Conditions are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

Before filing a legal claim, the parties agree to attempt in good faith to resolve the dispute through written communication for at least 30 days. Any unresolved dispute will be brought in the state or federal courts located in Aiken, South Carolina, unless applicable law requires otherwise.

Optional arbitration clause: Do not add a binding arbitration or class-action waiver without advice from a qualified attorney.

Severability

If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be interpreted or modified only as much as necessary to make it enforceable where permitted by law.

No Waiver

Failure to enforce a provision of these Terms and Conditions does not waive the right to enforce it later.

Changes to These Terms

We may update these Terms and Conditions periodically. Changes will take effect when posted with a revised "Last updated" date. The terms in effect when an order is placed will generally govern that order unless otherwise required by law.

Entire Agreement

These Terms and Conditions, together with the applicable order, approved proof, Privacy Policy, Return and Refund Policy, Shipping Policy, and any written quote or agreement, constitute the agreement between the customer and Peach Magnolia Studio concerning the order.

If a written custom-order agreement conflicts with these Terms and Conditions,

the custom-order agreement controls for that order.
